Relisting after NPB

When can I relist after a NPB. Auction ended 15 Aug, buyer did not respond to several messages, NPB reported 22 Aug. If I relist now will that prejudice me getting my FVF back.
There is no way that he is going to pay because I am 99.9% certain that the bid was to stop himself in another alias from being pushed too high after he had put in a silly max bid. His only one feedback is from over a year ago and is from the bidder he outbid. The second bidder also bought the same item from another seller on a BIN before he was outbid. Definitely suspicious.

I don't normally relist until I have closed the dispute and reclaiemd my fees just in case the buyer actually pays.
