new to this

hi ive wrote to my bank the alliance and leicester askin for the bank charges amount on my account i enclosed a cheque for the 10 pounds over 2 months ago but i havent heard anythin yet i did copy martin's letter sayin i would give them 40 days to reply. i didnt put on my letter that i was in financel hardship will this matter

any 1 help please would be gratefull

    They dont have to reply in 40 days. They do have timescales to adhere to though.

    Has the cheque been debited from your account yet?

    yes. You will just be added to the queue and put on hold pending the outcome of the court case. It's possible that is why you have yet to have a response. You need to state you are in financial hardship and ideally state the things that qualify you for financial hardship.

    They dont have to reply in 40 days.
    They do for a DPA SAR which is what the OP has done.
    You will just be added to the queue and put on hold pending the outcome of the court case. It's possible that is why you have yet to have a response.
    Not yet, the OP hasn't asked for a refund of charges yet, she's waiting for the SAR response.

    They dont for a claim on charges though. Although re-reading the post, it does look like you are correct in that they may not have been submitting the complaint but just the SAR.

    Post 1 was clearly about DPA SAR because key words, "sent letter with £10" (they wouldn't be bribing the bank, and "Martin's letter saying 40 days to comply"(that gives you the biggest hint since under the Data Protection Act 1998 the data controller has 40 days to comply with a request for all information about an individual from the specific company/organisation concerned.
