Fairmile Partnership recording default

I defaulted on my Nat West credit card in 2004. I am in Scotland so the debt becomes time expired in November.

The defaults were registered on my credit file at the time. The last contact I had about this debt was in 2006 (I think) when I was contacted by Westcot. I sent them a “prove it” letter and didn’t hear anything else. When I checked my credit file a few months ago both Experian and Equifax had the debt registered in the name of “Fairmile Partnership 1 LLP”, an organisation that I have never heard of (or from). I did move house in February 2008 but I had a redirection order on my post for 12 months and am certain that I have not heard from them.

I received an alert about a change to my credit file last week and, on checking, Fairmile have registered a default against me on my Equifax file, dated last week. On Experian, the default is still dated November 2004. I am 95% certain that the default had been registered with Equifax at the same time, so Fairmile have recorded a new default against an old debt.

What should I do now? I want to get rid of the new default on my credit file but not poke Fairmile too much for the next three months until the debt is definitely time expired.

    Be very careful.

    This may be an attempt by them to get you to acknowledge the debt. I would contact Equifax to get the default removed or the date changed, but not contact Fairmile in writing until the debt is statute barred.
