Yes I agree that there will always be a looser who is annoyed at not getting their own way but that is missing the point a bit. A dispute means that there is something that two parties disagree on, as a result there is always a potential to resolve the dispute or for a third party to intervene to make a ruling. A dispute means that each party has the opportunity to put their case forward and if the dispute procedure is fair then the reviewer will consider both points of view and explain the reason they chose to rule in the favour of a particular party.
I am NOT annoyed at loosing, I am annoyed that eBay just took action against me without giving me the chance to explain anything. Not only that the action is disproportionate to the action taken. It was negative feedback so the easy thing would have been for ebay to disallow the feedback if they ruled it was inappropriate and give a warning that if such an incident happened again that further action would be taken.
This is like someone claiming to have seen me driving at 40mph in a 30mph limit and being issued with an instant ban. No chance for appeal and no intermediate step such as fine. eBay are a law unto themselves it seems to be the case that anyone can open a dispute and eBay will just penalize the other person without any consideration.0
