Hi
I sent out the first letter to Capital One to try to reclaim PPI payments on my credit card which I have had since 2002. I claimed on the basis that 1) they had been fined for their sale of PPI in the past and 2) that they knew that I was a teacher with a permanent post and that they must have known that I did not need this insurance. They have now replied to me saying firstly that I am not one of the customers covered by the FSA fine and that if I had been they would have notified me; secondly that I signed the part of the short application form agreeing to the insurance (they sent me a copy of the form) and was sent the Policy Terms and Conditions. Consequently they do not feel obliged to refund my payments.
I would like to hear from anyone who is in a similar situation with advice about whether it is worth my time proceeding further with this claim or whether I should give up now. Has anyone else in this situation been successful in getting money back from Capital One?

If this is their final response then I would still ask the FOS if they can help. WIth companies where they are receiving large volumes of complaints they are actually looking at them individually on merits so always worth a shot.Hi

If this is not a final response then I would write back and reiterate the complaint in the hope they change their minds.
Other than that there are always the courts if you feel strong enough.0 -
Hi, i'm in the same boat like you. Sent my second letter yesterday. I guess the first response from them is standard letter sent out to everyone that tries to claim.

I received exactly the same letter from what you guys received today, they also sent me a photocopy of the application form which I filled, however For all we know they could have ticked the box for the PPI option on the application form and sent back a black and white photocopy so it be hard to notice.Bank charges Reclaim:
Capital one (c/c) = Won - £687.00: 8/2008
Cahoot C/A = £1300 pending until court case:rolleyes:
Natwest (C/C) = Caliming £276 = won £276 Feb 09
Baclaycard = Not Started-Cahoot (c/c) PPI Won £5200 -
I have tried re\claiming ppi from GE Capital, they told me I had to go to the original company who sold me the loan. I wrote to the original company only to be told that they have gone into administration!!.
I went back to GE and advised that as they paid over the funds for the loan and then have been charging me interest I felt it was their responsabillty to sort this out.
Consequently I received a letter from the receivers advising that I should contact the Financial Compensation as there is an insurance policy in place for these situations.
They have now written back to me advising that as my loan was taken out in 2003 I am not covered.
My loan was a secured loan over 6 years, however the PPI only covered 5 years and I was made reduntant 2 weeks after it finished so could not claim anhything, help.
Has anyone any advise on how to deal with this situation.0 -
As the FSCS cannot help what about the lender and asking FOS if they can make them responsible. I would also ask the FSA or OFT about your situation. This is so annoying when no-one can help you here cause of dates. You were probably missold like lots and because of the dates you have no way of claiming.
