How long can they keep extending notice period?

MY husband was given notice of redundancy at the start of the year, with a notice period end date towards the end of April 2009. All workers on the firm (small company, construction industry) went onto 4 day week at this time as well.
A couple of days before his notice period end date, he was verbally offered "some work next week". This week by week offer of work continued until I suggested he write to his employer and request written clarification of his position with the company and when they expected him to either finish or get his job back. The company wrote back to confirmhe was still under notice, with a revised end date of the first week in August. This date came and he was given another letter to extend his notice again to the start of September.
He has learned that other workers have been working a 5 day week again, and some even doing weekend overtime. The company say that this is because the jobs they are working on need the hours putting in.
Questions:
Can a company keep a member of staff on notice whilst others are back to full time and overtime working?
Is there a time limit as to how long a company can keep extending redundancy notice periods before redundancy pay becomes automatically payable?
