Advice needed - Charity auction hasn't come up with the goods

To be fair this isn't an ebay problem. If you had claimed for non delivery of your item (ie the interview) within the time frame they would have dealt with your enquiry. However It is far too late now for them to do anything.
ALso, the original auction is likely to have breached ebay terms and conditions anyway as all items auctions must be capable of being 'delivered' within 30 days for this very reason.

You'd think, wouldn't you? EMAP are massive, and given the fact that celebs are a pain in the bum you'd have thought they'd have managed something by now. I've written again to the girl who's been trying to sort it, saying that I think it's time I took it to a higher level. I'm going to give that a couple of weeks, then go to the top people at EMAP (Hurrah for google) and badger them. Failing that, I think it'll have to be a sob story to something like The Sun or Watchdog.
The only thing I'd asked of ebay was that they pass my details on to one of the other winners (who won the chance to go on a Smash Hits photo shoot) so that we could join forces - they didn't even bother to respond to the email - to be fair though, I no longer bother to sell stuff on ebay, so it evens out, haha...0 -
Don't feel bad in trying to get your money back. I'm sure this isn't the first time this sort of thing has happened and if people can't get a refund after being stiched up in these cases then people will simply stop bidding altogether on these charity auction no matter how genuine they are.
You owe it to all the genuine charity auctions to get your £800 back so keep fighting!

on a contract law point; i'll be able to answer this better next week after I finish my contract law revision! but obviously you have a valid binding contract with the charity, not Smash Hits, but they can frustrate the contract due to factual impossibility and give you back the £800 squid.0

Finally worked my way to someone senior at EMAP. They've refunded my money and they're also going to still try to sort out something like backstage passes for the sprog.
