Any Advice On £2000 Owed By Violent Ex Husband??

hi i hope someone can help me. my ex husband was violent to me for the middle 6 yrs of our 12 yr marriage until he got put on anti depressants then he just controlled me instead. however last august i persuaded him we should seperate and in feb this year he moved out. i lent him roughly £2000 which he was paying back every 2 weeks. however we had a huge row and he ended up kicking my door in and getting arrested which will go to trial in june. so he has stopped paying me anything. i owe this money plus about £2000 of my own and wondered if there is a way i could go about getting any money out of him. i have just had the letter from my solicitor with the decree absolute,and it mentions a maintenance order or lump sum which i have 3 months to apply for. could i go about it this way? i am on income support with 5 children and am really struggling now.. any advice would be greatly appreciated,thanks in advance
well that was ruined by lending ex oh £2450 to move out!!!!!! now estimate 21st march 2006hoping to be debt free by end of feb 2006 - fingers crossed !!

hi,
why did your solicitors not advise you on financial matters during your divorce proceedings?
With 5 children, at the very least they should have advised you on nominal maintenance orders. this would mean that your husband would need to pay a nominal amount e.g. 5p per year for the benefit of the children. even if you didnt need money now it leaves the door open if you require money for the children in future.
As for yourself, your entitlement if any would depend on various factors found under S25 of the matrimonial causes act 1973. these include length of marriage, earning capacity, housing needs, age of parties etc.
for any financial claim full disclosure of both your and your ex-husbands finances is required. is he working? are there any assets? if so you may potentialy get your money back this way. however unless he is earning alot or has any assets it is unlikely you will get much from him.
as you are on income support you are presumably being advised by solicitors under the legal help scheme. you should ask them to advise you on financial matters now.Proud Mummy to Leila aged 1 whole year:j0
