Sofa issue

Hi
I have been trying to get refund for a sofa delivered on 4th June from a known store.

When it was delivered I pointed out faults to the driver who took photographs on his mobile.

I telephoned my local store explaining the problem and they told me to contact their Customer Services (an 0844 number which I found later was 10p per minute when I received my telephone bill)

After speaking to Customer Services I was continually 'nagged' to accept a replacement instead of a full refund, in the end I agreed to on the condition it was 100% good and no faults to which they agreed verbally.

New sofa came about a week later and I stated to driver that would be checking it and if any faults then it would be returned and driver said that I had better come outside and checkl it before it was brough in as he wasn't prepared to bring it in only to have to take it out again if faulty.

On checking it in the street I found one fault and pointed it out to the driver (didn't check for any others as I stated to Customer Services had to be 100%) and so it was loaded back on vehicle and returned.

Now since then I have been trying to get a full refund (almost £1000) and they are refusing to give refund, have emailed and sent letters with no change in their refusal.

I have contacted Trading Standards and all tey tell me is to take them to small claims court and my credit card company will do nothing.

Has anyone any suggestions that will help me get full refund due to bad workmanship/faulty sofa.

I have tried sending letter to Manging Director of company but it got intercepted by Customer Services and refuse to pass it on to Managing Director (I addressed the envelope using his name).

I have copies of all emails and letters sent but am now lost as to what I can do to get full refund.

So how did you get on at the Small Claims Court?
  • So you are saying that is the only option I have ?

Thought under Sale of Goods act I could force them to give full refund or for Trading Standards to take the case ?

TS won't be interested - they've advised you what to do, and that's the end of their involvement.

To "force" them to give a refund, you'll need to take them to Court if they are playing silly beggars.
