Claiming Hardship from the USA

I have a pending claim with the Halifax.
I gave up my job in the UK in February 2009 and moved to the USA that same month, I still have a mortgage etc to pay in the UK but had my costs covered by a friend renting my house. My friend is moving out this Sunday.
Due to waiting for my work permit etc i am unemployed at the moment and have no income
All my bills are up to date in the UK but can only cover these for the next couple of months.
Could i claim financial hardship even though my bils are up to date and i'm not overdrawn with the bank yet?
Also, how will me being in the USA effect my claim?
I kept my Halifax account open to pay bills and my pending claim.

Any advice is much appreciated.

    You can but it is unlikely that they will refund.
    Also, how will me being in the USA effect my claim?
