CSA trying to claim for 1994?

Hi,
Does anyone know if the CSA can claim for 15 years ago?
There was an agreement set up at the time and money was paid into the mother's bank account. Unfortunately it was through Midlands Bank who no longer exist and frankly does anyone keep bank statements that long?
I am asking on behalf of my partner ( I wasn't around at this time). He had a letter from the CSA this week demanding the money or they would take it from his pay via his employer. This is the first correspondence for years.
He could ask the mother to state she was paid (as she was) but apparently she was claiming benefits at the same time and therefore has refused to assist. He was paying a very generous amount to save his son being kept from him.
Can anyone advise us please?

hi smiley
im not sure about if they can go back that far but if they can & they start taking straight from his wages D.O.E they can take up to 40% of his pay & they do!!!!!!!!! i would sugest trying to sort out payment direct with them0 -
They can go back to 5th April 19930

They can only go back to the first instance of involvement - when did she contact the CSA? Was it back in 1994 or more recently?0

Thanks for all the response,
It was back in 1994 when she contacteed them, it was amicably arranged. Also they are only claiming £760 and state it can be paid back £40 pm. It's more the principle than the cost as it was paid at the time. The CSA have said if she admits to receiving the payment she will be liable for the fine as they know she was claiming benefits...therefore she will not admit!0 -
Unless the law has changed they cannot chase arrears from before July 2000. So the case may have started in 1994, but its only the amount after july 2000 they can claim back.0

arrears can always be collected Arrears colletion via the court is subject to july 2000 but new laws will allow the commision to collect arrears via a adminl iability order so then there is no time limit. currently if you have a pre IMA calculated and are informed of the arrears today even if they are from 1993 they now become collectable0 -

That would be 40% of NET take home pay when using a DEO0 -
Thanks eveeryone for all your advice but the fact that it's been paid at the time is my main concern. As I've said I don't have my bank statements dating that far back and Midlands bank isn't around anymore. Just wondered if there is anyway of proving she had the money off me.

HSBC should presumably be able to find out for you? From Poland...with love.
They are (they're) sitting on the floor.
Their books are lying on the floor.
The books are sitting just there on the floor.0 -
We've asked apparently they only keep records for 6 years?0
