Can I clarify that you still use the account you are claiming financial hardship from?
    Is the account still open?
Do you have priority debt arrears(mortgage.rent. council tax, utilities)?
If the claim is in county court then the bank have 56 days to respond before you can go to the FOS.
You need to send in an income and expenditure form which is household income, plus notice of arrears.

We made the claim with mcoldec 2007 but were put off by the press. stays and all that stuff, the account is still in use, we received letters from the banks solicitors saying that the claim was on hold, where should we go from here? I know there's been a big lapse in time but surely we can still do this?

I have the letter ready to go claiming financial hardship and am aso going to enclose SOA as this clearly shows a shortfall of £850.

Relationship breakdown and supporting three children one of whom does not live with me.

I'll have a look at the SOA again and include any arsears, is there a budget form on here or should i send the SOA?

    Thanks

Don't forget to include as much information as possible. Send the SOA and any notices of arrears that you have(copies not originals).
