    By law if something is broken accidentaly in a shop they cannot charge you for it but claim from their insurance.

    Is that really so? I still see signs in shops saying "breakages must be paid for, etc"

    under the theft act they committed a fraudulant transaction by taking money from the owners card with out their consent.

    Yes it is theft you told them you didnt tell a newspaper .

    The theft was not against you it was against the credit card company .

    However if they can prove that you broke the item , you were not aware therefore did not have guilty knowledge . So it is a civil matter on the shops behalf to reclaim the loss / cost of item .

    Those kind of signs are not enforceable, if you damage something by accident they can't make you pay for it. However on the other hand if you willfully cause damage then they have the right to be paid for any damage at cost price not retail price.
