Incorrect Contravention code?

Hi,

I was parked in a shared use parking bay in Lambeth (both residents and pay and display). I had paid for a ticket from 15:17 till 17:17. I was parked because I had a job interview. The interview ran a bit late and I unfortunately did not have the opportunity to 'top-up' and only got to the car after the time expired (but not much after) only to find a friggen PCN! DAMN!

Now the PCN has the contravention Code as 19S:
"Parked in a residents' or shared use parking place or zone displaying an invalid permit, an invalid voucher or an invalid pay & display ticket"

The s - shared use bay.

Looking at the Contraventioin code listing from lambeth - this is the wrong Contravention Code and really should be a 5:
"Parked after the expiry of paid for time"

Am I wrong here or does 19 cover my situation?

To further it - the observation time was 17:22 to 17:24. That is pretty grim - 5 minutes after expiration! I probably got back to the car only a couple of minutes later!

I still have the pay & display slip. DO I have any grounds at all or do I have to cough up £40!?

I'm hoping you can shed some light!

    That's quite an interesting one actually.

    On the face of it you would be right --'wrong contravention' --- since there is a more appropriate description available.

    Then again, 19 is also a lower level penalty and, yes, could be judged to describe the situation.

    As they are not trying to penalise you at the higher level you may have a job to persuade an Adjudicator to agree with you. Then again - back to what you originally thought.

    I'd be really interested to see what my colleagues on 'PePiPoo Forum' think of it. I suggest you post there.
