Problem with window company refusing to fix issue

Hi,

This has been going on for a long time so I will try and keep it as brief as possible.

Basically back in 2005 I bought a window and roof installtion from a company called Excel Windows. Everything went fine and dandy. I had a seperate builder do the brickwork.

Around a year later we noticed one of the polycarbonate panels was filling up with water. We called them out they did turn up and the engineer decided we needed a new panel. He tried to clean some of the debris that had got in there with some kitchen roll which to this day is still sat in the polycarbonate for all to see going slightly green!!

Nothing happened for ages. Finally after a year of bugging them they said that the engineers report was too old and they needed to send another engineer out.

He concluded the same as before(it was the same guy) Yet again nothing each time we phoned up.

Last year I was sat in my conservatory and noticed that i could feel some air running down my kneck. I had convinced myself it was from the cavity by the little gaps around hte plug sockets(which i ahdnt properly filled in yet).. Until i looked up and noticed that one of the poly carb panels had slipped away form the lean to wall and there was a half inch gap.. OMG

So i phone them up and finally get them to come out. Once agian nothing happens for ages until I decide to start phoning everyday!

Once I have the attention of the owner(who sold us the conservatory) he arranges for a phone meeting with him and his engineer. He basiclly tells us we have invalidated our warranty as "somebody" has taken the roof off..!! He basiclly goes onto to imply that we had another builder take off the roof so they could put the coping stones on the lean to wall. There we already put on months before they even installed the whole thing.

I have no picture proof of this though :( The closest I can get is receipts of the coping stones more than 6 months before the conservatory was installed.

The same panel has fallen away again and they are telling us to go away as we have no warranty with them!

Does anyone have any advice as to what I could do? How can they just invalidate our warranty like that? is that legal? I have been fairly polite to them although I directly accused them of getting their engineer to say what he had to in order to make our warranty invalid, I have tried to reason with them and ask if they would be willing to have a third party of un biased come in and inspect the roof. To which they againt ell me to go away.

Any help would be so greatly appreciated im at my absolute end with this :(.

  • I am sorry I don`t have any advice other than to suggest you ring Consumer Direct to see where you stand with this. I would contact them ASAP as I think there is a 6 year limit for claiming for faulty goods.
