Paid By CC - now have problems

Purchased recliner sofa from land of leather last may, in Jan noticed several issues including a cut hand from staples sticking out, the mechanism causing the leather to tear, the seat sinking and the chair seeming offline(leaning to one side)

There is only myself and Hubby here and we sit on it for a MAX of 3 hrs a day.

Someone came out from LOL and said to hubby that it was clearly a manf problem. When we spoke to LOL they said he said that it wasn't a manf problem but he didn't feel we had done it either! I know - I was confused too.

we were in talks for a long time with the store manager until they went into administration, we then got no sense out of them and decided to contact Delloite who were in charge of the administration. Again only a standard respose and despite chasing them we have been ignored.

we have insurance but the manager said that the insurance wont cover manf faults!!(this clearly is )

We spoke to consumer direct and they informed that because we had paid by Natwest gold CC we had cover with them for upto 6 years.

Natwest say that is incorrect and that we are only covered for 120 days if the product isn't delivered!

We re now confused and would like your help

Have you gone through this?
what happened?
whats the best approach?
Is it normally a case of the small claims court?

any help would be appreciated.

    Sorry what your bank have advised you is incorrect. it may be that you have had someone with little experience regaring LOL. the 120 days timescale quoted is their timescale to issue a chargeback. they are right it is out of time.

    Few things. I would obtain an independant report confirming the item/items are faulty/not of the required quality. Send this to your bank with your letter detailing your contact with the merchant/Invoices etc.

    They HAVE to look at this under section 75 Consumer Credit Act- belive me your not the only one thats had such issue - see them at work all the time.

    If the item is repairable you will probably be asked to get an estimate and bank will foot the bill to restore item to original state. otherwise if its beyond reasonable repair they will foot the whole thing.

    Good luck you will get it sorted your bank cant not help.

    hi we have a 5 yr garuntee on ours but now has a few faults is this still in force since they went down ?

    We have received a response from the CC company and they are asking for an independant report from a reputable retailer detailing faults and any cost of repair.....

    Is this normal? Can you recommend anyone? Do we have to pay for this quote?

    120 days is in relation to 'chargeback'.

    Section 75 is different and for much longer ..........

    Hi,

    I would have thought you would have to pay for it .... but the bank will have to give you money back if found at fault - check with CC.

    Do you have a local independent retailer in your area - or maybe someone who fixes furniture?
