LA Fitness Contract

Hi, My brother who is blind joined LA fitness on the 27th of May and a employee of LA fitness read him his contract as he is blind and my brother became a member.
He comes back at the end of the month and I keep getting calls from their late fee department and calls saying he has to pay.
I sent a letter to LA fitness Member Relations department and stated the following as I read him all his letters and write his letters for him:

Membership number: DER#####
My name is Abbas and I joined LA fitness on the 27th of May.
I am blind and one of your staff member at my local LA fitness Derby, his name is Jamie and he read me the membership contract and told me that their would be no fees involved in freezing my account as I told him before I signed up that I will be going abroad in July and would need to freeze my account. As he told me that their was no fee I thought I may as well join for the month and resume when I come back, rather than join when I come back.
A few weeks before I was to leave, I asked Jamie and he said that he will freeze my account for me, I asked him several times to confirm if had frozen my account, and he kept saying he will.
A week before I left, I was informed he was on holiday and won’t be back until after I had gone abroad. I then rang up to freeze my account and was told there is a monthly charge.
When I signed up, I was not inform of any charges, and I can’t believe that because I am blind, a member of your organisation saw it as a opportunity to entice me into a contract.
I am currently abroad but had my brother go to the Citizens Advice Bauru and they have informed him that no contract exists as I was mislead and not informed of what I was getting into and have a legal right to terminate the contract and may be able to recover any costs I have incurred.
I have sent two emails dated the 13th July 2009 and 20th July 2009 and have not had a reply back in respect of this issue, I then had a recorded delivery letter sent on the 09th of August and my brother was contacted saying that I need to pay.
All I am interested in, is to terminate the contract as I was mislead, and I hope that LA fitness does not do this to all prospective members.

I don't believe a contract exists and am more than willing to fight it out but does he really have grounds ( I made the CAB part up) to terminate as he was told that no fees would apply.
I would appreciate your input.

I have been told by a blind business colleague that his signature to a legal document such as a contract is not valid in law unless it's witnessed by a solicitor!
Could your brother therefore claim that the contract has no legal basis?0 -
