Hiya,
Last year I was unfairly dismissed. My employer altered witness statements and dismissed me for attempted theft. What they did was entrapment, then I discovered the discrepancies in the statements and the incorrectly followed procedures.
After 7 months out of work (couldn't apply anywhere as I live in a small town where everyone knows everyone and I had gross misconduct on my record) I was finally reinstated. They gave me back pay but I was on minimal contract hours as I was a student but used to work full time as overtime in the summer holidays, which was the period I was off for. But they haven't given me any compensation.
I have been back since December and have requested it in writing that the company are not offering me compensation and the original copy of the 3 witness statements. I want these for my records, as this is the second time I have been unfairly dismissed from the company. I have requested them by phone and in writing about 10 times. So far I have 2 out of three witness statements, convenientally they did not send me the most important one with the huge discrepancy and alteration.
What do you advice I do? It is the head of the H.R department for our area that has been dealing, or not dealing, with it. She is ignoring me and I want those documents for my own records.
Any advice or suggestions??
Thank you in advance

To paraphrase Oscar Wilde, to be unfairly dismissed once seems unfortunate, but to be unfairly dismissed twice sounds like carelessness.
Are you SURE you want to work for them. They don't seem to like you very much, and vice versa.0 -
So they accused you of stealing and falsified statements to make it look true...you found them out and proved them wrong...then you went back to work for them?
I'm shocked that they would want to work with you (I would be embarassed to work with someone that proved I was a liar) let alone that you would accept the job!
If you have chosen to work with them again, you can't now go through all this old stuff again. Why don't you just forget it and concentrate on whatever your job is....you're presuming they're going to do something again, before they have! If it's getting to you that much - QUIT!0 -
That's a bit on the harsh side!
Sorry to hear that you were so badly mistreated. You are entitled under the DPA to see any and all documents, including investigatory documents held or used against you. These should have been provided to you in advance of the first disciplinary hearing. Well done on fighting your corner. I think in your situation I would have went further and sued for defamation of character.
Were you reinstated with your continuous service intact? I would suggets arranging a meeting with the Head of HR and get her to explain face to face what the problem in providing this information is. Politely but firmly explain that you are within your rights to view any information held in your employee file. If she still ignored you, go above her head to her boss and get them into act.
Kind regards,

Thank you for the reply Billy. I think i will just write to the head of H.R. This woman whose supposed to be head of h.r in this area has always been incredibly rude to me. She took the position just after I was reinstated and I've found her attitude and lack of professionalism quite shocking.
I'm only 23 and have worked in this job for 7 years. I'm not prepared to let them win or think they can dismiss me just because they feel like it. This whole thing began when we had a manager about 5 years ago who was completely mad and irrational. He gave me the employee of the month title and prize then gave me a disciplinary for persistant poor performance! He put it straight on a final writen warning, and this was the week before he left! He was just trying to prove he was a good capable manager and just happened to chose me for his sillyness. I appealed against the decision on the grounds I had done NOTHING wrong and was employee of the month! The area manager did the meeting and I found out after they are best of friends and spend time together out of work etc. So as you can guess he was very rude to me, shouting and threatening me. The final writen warning stayed in place, but as we had a new manager and I'd never had any experiece with these things I left it.
But since that meeting the trouble began...but I wont let them win.
Plus, there are absolutely no jobs round here at all0
