I am in the right here...arn't I?

I won an item the end of July (actually more then one but to make this easier, I'll just call it one item)

It never arrived.

I had paid alot of postage for it to arrived. I assumed it was recorded delivery or something, but to be honest, I see the postage fees, I agree to them when I bid so they are not the issue here.

I contacted the seller who said he "had proof", asked for my address, I waited a few more (6 more) days.

I then emailed back via ebay. No reply. Waited 2 more days then went though paypal as item not arrived. I had not escalated the claim as I wanted to get the sellers attention and see if we could come to some arrangement (I really wanted the items!).

Then today, I get an email back from the seller via ebay. It says I was rude asking about the item...etc etc (I was not rude- I had my friend check my email, my mum reread the email I sent since, neither said it was rude. It was just asking if the item was sent recorded as then we may be able to get some more tracking info which the seller took badly for some reason and yelled at me (partially written in capital letters) if I didn't like the postage to not bid. That he was willing to come to some arrangement but as I was so rude he was not going to do that anymore, that he had x amount of positive feedback.... and I would need to go to the post office through the "proper channels" if I wanted to resolve this now.

I have now escalated the claim through paypal. I don't think this is what he meant by "proper channels", but its the way I see the "proper channels". I let the seller know and apologised if he thought I was being rude it was not intentional.


Am I right in thinking that its his job to be incharge of the postage and get any money back himself- not me? if so, is it up to paypal to refund me and not the post office?

    Yes, it's his responsibility to ensure the item gets to you. If he can't prove the item has been delivered, PP will refund you :)

  • I would continue with the claim and ignore the seller, Paypal will find in your favour as he cant prove tracking.

    Thanks- not selling atm (rarely do) but will block him anyway as I don't want to suddenly find everything I bid for going sky-high in price before a retracted bid leaves me paying double what I could have- if I block him, does he still see what I bid on? or is it only going to stop what he sells/if I sell anything.

    Open different accounts for buying and selling. He can track your ebay behaviour through some third party sites, but it's nothing to worry about really.

    No-one can see what you bid on. ;) All it does is stop him bidding/buying your listings.

    You have nothing to worry about, OP. If he can't prove delivery, PayPal will find in your favour. Don't bother communicating with him any more, just follow the dispute process and wait the time it takes, and you'll have your money back.
