Mamas and Papas - faulty cot bed!! Help needed!!!!

We purchased a Mamas and Papas Savannah cot/bed from Lisburn Baby Shop. We returned home and the 2 end panels were damaged. As advised in the instructions leaflet we phoned the helpline. They said they couldn't help us, only the store from which we bought the product could open a complaint. The lady on the phone admitted that it did state that we could use the help line but it was no longer company policy. The bed that we bought was different to the picture on the Mamas and Papas website. We were then told there was different models but they had no way of know which model was which and therefore could not order a spare replacement part. We returned the cot to the store the next day to the Ballymena branch of the Baby Shop as advised by the Baby shop and the help line. We drove home; opened the product only to discover that it too was damaged. We rang the store who opened 2 new boxes to find that they were also damaged (design flaw where screws are breaking through the wood). They informed us that they had 2 undamaged cot ends in the Lisburn branch but when we drove down the owner then stated that they were also damaged and cracked. We were given a refund but we have already build the wardrobe, chest of drawers, book shelf and cannot return these items.

What rights do we have as a consumer? We would like the cot/bed to match the rest of the furniture. To purchase from Mamas and Papas online it is £25 more expensive. It states on the web site to ring to return goods from home of damaged, I was told this was not possible. My nursery is a mess and I need it finished!!! Help please:confused:

    Unfortunately for you, under Consumer Law, the contract (sale) between you and the retailer is effectively over for your cot bed because they have offered a suitable remedy for faulty goods that you have accepted, a refund.

    There is nothing legally that says the retailer has to accept none faulty goods back, or that they must compensate you any difference for you to purchase the same item from elsewhere.

    Did the shop say if they would be getting any more/any similar items back in stock, to match your other furniture?

  • Have you tried the mamas and papas outlet store in Huddersfield? It maybe too far to travel, but they may have it cheaper in there and deliver it. Sorry can't be much help.
