I am truely amazed at this consumer crusade... Now I am joining the ranks to fight the rip-off banks of england!
I am starting my claim today for Bank Charges against Barclays...
I am starting my claim today for Credit Card charges and unenforcable agreement with Capital One....
I am starting my claim today for PPI and unenforcable agreement with Tesco Fianance (RBS)....
I am starting my claim today for PPI and enforcable agreement with HFC (HSBC)....
I am looking forward to working with all you experts to help with this if you can!!!?
I will post more indepth details of the amounts etc as I get them finalised...
In the mean time can someone advise me how a claim of Financial Hardship works.... as I can't afford to pay everything oin the month and literally have no spare income... does this count?

            Just to add does Financial Hardship count as being in arrears with my utilities.. i.e. Gas/Electric and Water?

 It's either unenforceable or you acknowledge the card and have charges.

 If you have priority debt arrears(mortgage/rent, council tax, utilities) then maybe

            Theres another two closed accounts that went into arrears a few years ago and I made a Full and Final payment to clear the debt... can I claim for unfair charges on these... or did the F&F stop me from being able to pursue that in the future?0

            I have just realised I have a problem.... I can't send a cheque for the break down of bank charges as I don't have a cheque account.... Whats the recommended way out of this? If there is any? Postal order? Cheque from my partner? HELP :S0

 Either but if it is a cheque from your partner make sure she writes on it "for the purposes of DSAR" so that it is clear that if it is cashed that sufficient information was given to them to provide the information.PacalsPenniesCount wrote: »I have just realised I have a problem....             First round of letters for a break down of charges going out today!!!! Yipee... Now from what I hear.. the banks and credit card companies can drag their heels all the way to the end of the 40 days..... !!!!!!s....
 Anyway, Watch out Barclays - Barclaycard - Capital One... this consumer is getting clued up to your unlawful ways!!!
 I also have sent my claim letter to HFC for the PPI on a small loan with them....
 Keeping my fingers crossed for speedy responses.... once I have worked out my claim amounts I will be filing for Financial Hardship.....0

            I have also decided to leave of Tesco Finance for the time being.... they have a well structured contract for my loan (which had been taken out in 2004).... not sure if theres anything there thats 'unlawful' 'unfair' etc.
 *Help Needed* - Does the contract have to detail the charge in numerical values for late payments etc... Is there any examples of 'bad loan contracts' that I can use as a guide to compare with???

 Hello there.;)
 Basically in regards of reclaiming PPI within unenforceability terms I am not aware of but if you have been mis sold for any reason then you should try to reclaim on this anyway.
 With your reasons you have, you write to them to reques that they refund you all your PPI and interest paid, if the account is settled, you reclaim the full whack of the PPI, plus the interest, also the 8% interest of what a court would award, as you have been out of pocket due to being mis sold.
 If the account is still active, basically they should out you back in the position as if you did not take out the ppi, and you can request that they refund you the PPI you have paid, plus the interest etc.
 They have 8 weeks to respond in full, you need to keep on at them, as further letters maybe required, or until they issue you with the final response, this one they should also enclose details of the financial ombudsman service (FOS), if your not happy with the outcome of your complaint then you should be able to if eligible to move your case on to these so that they can investigate.
 Best as well to post by recorded delivery, as this would be your proof of posting.
