T Mobile in store upgrade

I have posted this on the mobile phone board, but perhaps it might be better here?
I recently upgraded my mobile phone in a t-mobile store, and since doing so found out that I would be eligible for a better model of the phone I plumped for.
I have contacted the store and they have told me that as it was done in store rather than online or over the phone there is no 'cooling off period'. I was wondering if anyone out there knows if this is the case or if they are trying to pull the wool over my eyes?
The upgrade was only done on Monday (17th) so it has been two days, surely I should have some consumer rights to return the product?
All help appreciated.

Yeah i made a hash of this one too! mine was done at Carphone Warehouse though.
I ended up with a worse spec phone paying the same price I did for the last phone!for another 12 months!
Never again! I even missed out on my free laptop/playstation/etc.
stupidity on my behalf - but then again quite sly on their behalf - they showed me a high spec phone - did all teh crap about ringing T Mobile Blah blah blah - wanted another £200!!!!!!!! plus the contract! I said no, so they got me out a phone conveniently packeged in a box and said I was eligible for that. I foolishly took it cos I wasted 30 mins in there.
Conned, basically.
Although the handsets functionality is fine it certainly isn't swish.
But , like you say, no cooling off period, which they happily "Hand write" across the contract. I think it "could" be a fraud or theft provention method but im not sure.0 -
Unless the phone is faulty or damaged, you have no rights to return the phone. You don't get a cooling off period for purchases bought instore. Although you do have the right to reject the goods if they do not conform to contract (i.e. it doesn't do what it says on the tin) but I doubt this will be applicable in this case...If it looks like a duck, and quacks like a duck, we have at least to consider the possibility that we have a small aquatic bird of the family anatidae on our hands

No, you weren't conned, you simply made a bad decision. You weren't FORCED to take that phone, you could have quite easily said that you didn't want that model and you would go elsewhere. Just because you didn't get what you want, doesn't mean it is their fault...
Er no - i disagree
it is a form of pressure selling- All the lies and deceits about "attempting" to phone T Mobile and then them saying I couldn't have that model - keeping the customer waiting for far too long -and why the constant trips into the back room to make the phone calls? they got something to hide have they?
and no - i couldn;t really go anywhere else - remember - this was just a vendor selling me a phone to a "provider" I was already with i.e T Mobile.
It was implied that it was T Mobile deciding what phone i was "worth". Why would it have been any different with any other vendor attempting to offload a handset?

I accept that I was naive - but why not warn others? if it happens to enough it deserves mention.
You might not want to admit it but I beleive their is a "structure"for a member of staff to handle a contract upgrade at Carphone Warehouse.(And I don't think it is biased toward the customer). Defend them all you like - you won't change my belief!0 -

You went to get an upgrade
The phone you wanted was too expensive
They offered an alternative
You accepted it
What YOU should have done is...
Gone for an upgrade
When you find out the one you want is too expensive, either say:
1) I'll wait until I CAN get THAT phone
2) if you can't give me what I want, I'll take my business elsewhere
And there you would be, with either a shiny new phone you wanted or you would be free to cancel your contract when it was up and go elsewhere.
At NO point were you told this is your ONLY option. You DECIDED to take that option...
