Question about the FOS

When you are putting in a complained about non repayment of underlawful charges on a credit card, can you send download the forms, fill it in and enclose letters, break down of charges etc, or do you have to contact the FOS first to ask them if they will take the case , or is it ok just to send the paperwork in straightaway......thank you....:rolleyes:Lilly

    You dont have to contact the FOS first.

    Your first make your complaint to the provider. The FOS will only take on a complaint once you have been deadlocked by the provider.

    To add to what dunstonh has said. If you approach the FOS firstly then they will merely send the complaint to the provider to give them the opportunity of responding to you before they will take the case on.

  • Thank you very much, both of you,. its just as I thought, we are at deadlock, and I have all the paper work....so I will just send it all of, and hopefully the FOS will be able to sort it out....just really feb up with this company...they have really dragged out answering any letters that I have send them in the past...like 9 months before they send my statements!! another 6 months before they answered my complained...wish me luck...and thanks again....;)Lilly

    40 days for Date or complaint to Information Commissioner's Office (ICO)
    56 days from the first letter of complaint to organisation then complaint to FOS ;)
