Made Redundent Whilst off Sick (due to accident at work)

Hello,

Hope someone can tell me what to do now?

I had an accident at work which resulted in time off work sick. Whilst away I have now been made redundant - I was on SSP and got a letter to say that the company will be now being paying my full wage, holiday accrual and redundancy payment - but do I still need a sick/doctors note?

Because I got confused (having just got the letter and then seeing a specialist) I have now missed 2 days..... can they now sack me for no note and not showing up to work? I have been off for 6 months due to the injury whilst at work?

Please can someone let me know what I have to do!!??

    Must be a bad injury for 6 months off.

    My work did same to a guy who just stopped turning up one day, still had his sandwich box on desk. He was off for 6-7 months until eventually rhey made him redudnant with wave of other people....

    Unfortunately cant be on the employers books for ever :(. Its sad but true... if it was works fault i'dve sued em as opposed to stay on sick etc.

    What was the injury if you mind me asing>

    Phone your employer and ask them. It's unlikely they will care about a 2 day lapse in a sick note, but only they can tell you if they do.

    Phone them first and if they kick up a fuss come back here for further guidance.

    "Suing" your employer (better defined as making a claim against them) does not negate the need to "stay on the sick".

    If the OP is injured she has no alternative but to be off sick.

    OP, speak to your employer and see if they still need you to send in sick notes. Once you are made redundant, you won't have to and you will need to apply for state benefit - Employment & Support Allowance. I don't know how your redundancy payment will affect this - you could ask for advice on the Benefits board or speak to a benefits advisor.

    If you feel that your (former) employer was at fault for the accident, then see a solicitor about pursuing a claim. If you have been considered for redundancy based on your sickness record, and your sickness record is down to an accident that is their fault, your solicitors will include a claim for loss of earnings, both to date and in the future.

    If you are still employed you must continue to submit sick notes even though you are under threat of redundancy.

    If you see your GP promptly s/he will back-date the new sick-note to the date when the last one ended. It is unlikely that your employer will take any action on what is obviously an oversight.
