    Hi never

I'm sorry, I didn't mean to offend, my head just isn't in it's normal place at the moment so I guess I'm a little emotional :(

I will look at the agreement again but I might have trouble posting an image as I didn't get the option in my first post...

    Will let you know :)

    Hiya

You post image onto imageshack or something similar then post the link on here ;-)

    Hi never
I've just re-checked the application I made for the terms you mentioned above and I have listed below what I think is relevant but I stress that what I think is relevant may not be and it is for that reason I have been asking for someone's help.

I should point out that although the text refers to conditions, they don't seem to be listed!?!?!?

    Here goes...

For B (repayments), I have as follows,

    3. By the payment due date shown on the relevant statement you must make at least the minimum payment shown on the statement, unless we allow a payment holiday under condition 2.4
    4. The minimum payment shown on the statement will be the geater of:
    (a) 2% of the account balance as shown on the statement, or
    (b) £5, or the account balance as shown on the stetement if less than £5
except as mentioned in conditions 2.4, 3.5 and 3.6

For C (interest), I have as follows,

    5. We will charge interest on the outstanding amount of:
    (a) any retail transaction at 1.1578% monhly, except as mentioned in condition 2.1
    (b) any cash transaction, cheque transaction or balance transfer
    (i) if made during the period of six months starting from the date of opening the account, at 0.1610% monthly during that period and then at 1.1678% monthly, and
(ii) in any other case at 1.1678% monthly and
    (c) any charge under condition 13.1 at 1.1678% monthly.
There is also a table under this showing a few credit limits and retail transaction and cash advance apr's

For D (credit limit), I have as follows,

    1. We will from time to time choose the credit limit and notify you of this

can you post the agreement up? It would be useful for everyone. There may be all sorts of flaws within it that different people could spot for you.

additionally, I am still waiting for mbna to send me mine. My account is possibly same age as yours.
I recently successfully claimed back charges from them (which knocked about £700 off the debt). They were more forthcoming on that front than other c/c's have been.

Why did it knock off the debt? Did you not do it right? If you did it correctly then you should demand payment to you - not released (offset) against the debt

Maybe you ought to read some of the threads on here for advice in future and we'd save you some money! :D

LOL, you keep having little digs about wanting to post the terms up and for the 4th time now - we can only help you on here and actual sight of the terms doesn't mean much - obviously one of us can say yep - they are wrong, but then what? Do you think having more digs will prompt us to do your legwork?

    Nooooo!

Anyway, from you've said the prescribed terms are not intact and therefore you ought to send off the letter found here: http://forums.moneysavingexpert.com/showthread.html?t=1868507

    Look for this

    4. Lets assume they respond to your CCA but there is incorrect data showing, for example the prescibed terms are not intact. Then you'd send the following letter;

I don't think I 'll bother, thanks. I will go to another forum where the people are nicer.
