can i claim hardship

I have recently been chased by Abbey for an account with £1400 overdraft, this was made up of bank charges.. and when checking all statements they have charged me approx £2k+
I make ends meet each month, but have a debt management plan and loans. and now this £1400 bill.
I have put a claim in today to claim these bank charges back, as I ahve threats of debt collectors at the door and no way to pay this money (it came out the blue) can I claim hardship based on this?

The answer is no but you can tell the DCA that the account is formerly in dispute and so under OFT debt collection guidelines they cannot chase a debt in dispute.
Tell them you will pay them nothing and that any court action taken would be vigourously defended.0
