bank and credit card charges

ok here goes
at the moment i am on esb and i am unemployed. I have a bank loan with lloyds tsb and the loan is more than i collect in benefits from the state. I have made a claim on the insurance with lloyds and they have been paying this late sending me past my £1500 overdraft. I recieved a letter from the collections agency saying to contact them immediatley so i did. I was told that i could not have the charges back which total about £350 in the last two months. I was then told that it was my own fault that my account was overdrawn as i was unemployed. I wanted to try and keep a good relationship with the bank as i am in finacial hardship at the moment.
1- so question is does any one know how to make a formal complaint to the tsb, I got the mans name who i spoke too.
2- I have made my mind up to claim the charges back for 6 years under the hardship rule, Is there any pitfalls like will tsb ask for my overdraft to be paid back straight away.
3 - I will also go after credit card charges. My credit cards was with tsb. the first card was a visa and then this was replaced later with a mastercard. so do i ask for the statement charges for both and pay one fee of £10 or would it be £10 for visa and £10 for mastercard.

    I would be tempted to go down the line if you complain about the member of staff of the fact that you took their PPI to cover you in case you were made unemployed yet the very nature of how you claim the PPI has caused the charges.

  • i thought that you could on claim back 6 years and not until july 2001.
    If i can claim back to 2001 does that include the credit cards aswell?

    Credit Cards is 6 years (so August 2003)

    Bank charges have a special thingy from the FSA Waiver not to account for time since the test case started so is really 6 years back from July 2007 - thus July 2001.

    No unfortunately it doesn't include credit cards. As there is an OFT test case the 6 years clock stopped at the point the announcement was made which was 27th July 2007 so all Bank charges 6 years from that date until the conclusion of the OFT test case issues can be reclaimed. Credit cards are not part of the OFT test case.
