Selling HP ink cartridges on Amazon

Lots of sellers on Amazon are selling HP ink with expired "install by" dates. They work fine but I've been told that its against Amazon rules to sell these as NEW because they are not in date, however everyone else on Amazon is selling them as NEW, not LIKE NEW as I have been told they should be.
Most people just list them a lot cheaper and state that the date has expired in the description
I have spent ages trawling the rules on Amazon and cannot find out which way is correct. Please can someone help
