Is there a time limit?

on how long you can take action! If a bank makes you an offer, of say £400 out of £1000, and you say ok I will take that (as part payment and without prejudice) but I am taking you to court or the FOS, for the rest, then they write back and say their offer is still open but I have the option of 6 months to contact the FOS if I'm not happy, can you be held to doing it within that 6 months...or can you do it after the six months....say 7 months or two years or whatever....!!!:rolleyes:...can the Banks really put a time limit on it?....;)Lilly

When was your original offer and acceptance of the part payment ? (before or after July 07)

Yes you should be able to go back for the rest still if you only accepted as a part payment. (and did they actually pay you the part payment ? or retract it when you said you'd accept it for now but continue for the rest)

Hi and thank you for answering my thread, yes I am in that postion!!! Capt one bank (credit card) offered me £400+ £30 interest out of £1.366.52 which I had asked for!! they enclosed a Complaint Settlement form for me to fill in and return, which I never did.. I still have it....so it is time to put this to bed if possible, and thought I should try and reclaim all of it if poss....I am afraid this letter was dated 7th August 2007...but they said I only had 6 months to go to the FOS, is this correct,? have I left it to late!?....can I still try and claim it back, or will I have to pay it back, because it was overlooked!!!and to be honest, forgotton about......I never received any money and they didn't retract it, just said the offer was still open and I could go to the FOS within 6 months if I wasn't happy....:cool:Lilly
