Paypal place limitations on my account due to Michael Jackson 'tickets'

I have had an email today saying that my account has been limited until I have proved that I have refunded a buyer who purchased Michael Jackson tickets from me.

The only issue is that I never sold any tickets, what I sold was a pre sale code, which had risk attached to it as it didn't garuntee tickets in the first place.....

I have read the OFT article they pointed me to, and it mentions nothing about the pre sale codes.

Where do you think I stand on this, hell will freeze over before I willingly give a refund!

    think you need to phone paypal with this one
    take it this was just a code for a queue place?

    What category did you sell the code in? If it was tickets then ebay will have just picked up the fact that you sold 'Michael Jackson' and 'tickets' and you may struggle to find an easy way out of this as paypal are not always logical.

  • It wasn't a lot, about £30 I think.

    Its not an amount that is worth too much fuss, especially if Paypal put me in the red, I wouldn't want to have any kind of adverse credit effects due to it. Its more the principal, it was always going to be a risk for the buyer, its not tickets, would they have done this if the buyer had fallen ill and couldn't go rather than MJ popping his clogs? Very unlikely!

    Do you not have any record at all that would help you decide where you sold it? I rather suspect that along with most people you sold this in the ticket section and have therefore unfortunately been caught out by using the wrong section and been picked up by bot as having sold a ticket.

    All you can do now is argue your case with paypal, I'd also check out the ebay community boards though in case others have problems as well. If you do post there do not use your main account to post.

    You can't get any adverse marks on your credit file for this, ebay have not given you credit therefore it is impossible to be in default.

    With regards the other more plausible option of giving you a ccj well first paypal would have to refund the buyer and there be no money in your account thus putting you into a negative balance, then send it to a debt collector who then pursues you through court, however this unlikely to happen and if you auctioned the goods then legally impossible as you are not legally obliged to refund the buyer if you auctioned the item, so if, in the event of ever actually receiving county court claim papers, you entered the defence of "item was auctioned as non returnable in accordance with the exemptions of the distance selling regulations 2000 the refund effected by paypal was done without my authorisation and i accept no financial liability for their actions in this case" then job done the court are not going to over rule the distance selling regs to please paypal.

    So if this is a matter of principal for you stick to your guns and don't worry about getting bad credit as a result.

    Oh and you just need to ring paypal and make a fuss, unfortunately that's all you can do with these clowns in these situations
  • I sent one email tp Paypal stating that I didn't sell tickets and today the limitations have all been listed.... easy peasy, I expected a fight!
