You can try, however it is much harder and less successful than with personal accounts since the ruling in the oft test case that materially the same terms are used and defined as not being capable of being penal. You are unable to use consumer legislation such as the utccr to define the charges as unfair so it can be sticky. However you can write to the bank to complain about the charges and ask, I just wouldnt recommend taking it to court.

  • Hello. Can anybody help? I have written to RBS regarding my bank charges under financial hardship and they have made me an offer but it is approximately 40% under the full amount and the FSO have written to me to say this is a fair offer but I do not agree. Should I accept or carry on?

Offers under hardship are interim payments, if it will help you out I would accept and keep the rest of your claim in for the end of the test case - it will keep accruing interest too.
