Parking ticket - incorrect details question

Hi all

I received a parking ticket yesterday in an APCOA operated railway station car park.

It seems I paid up until midnight Saturday, not midnight Sunday, so I do not dispute that I am in the wrong. However, I believe I may be able to wriggle out of it and wanted clarification.

On the ticket, there are 3 details related to the car - colour,make and registration. They have put the right colour and registration, however, the wrong make (they have put Saab where the ticket was put on a Seat). Is this grounds for being right not to pay?

If so, what course of action should I take?

  • i think this is legally a right not to pay, as they could have issued the ticket for your registration on a different car? i.e. stolen etc... They have pictures too but if their system is wrong and you complain i dont think they can argue back

    Assuming the ticket does not say its issued under railway bylaws or that its a council run car park then the best thing to do is:-







    Nothing.
    Just ignore them and don't reply to any of their junk mail and they will go away a lot quicker.
    You will get a few "scarey" letters and even some with coloured writing and even tame debt collectors who have as much power as you and I. Less in fact, we have the power to ignore them.
    I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.

    Several companies claim to issue under the Byelaws but do not in fact have the authority.
    It is what the tickets says about enforcement that is key. If it talks to claims proceeding through the county court then the ticket is fraudulent.

    Ok, I have it in front of me now.

    There is no reference to Byelaws. At the top it states "Parking Enforcement Notice".

    The only legal reference made is that on the back it says "Should payment not be received within the specified times, a summons will be issued in the county court where judgement will be sought for debt to include any and all costs incurred in recovery".

    My assumption therefore is that it is an invoice, and I can email them/call them to say that there is no such car as make x with colour y, with registration z.

    Thoughts?

    Don't bother, they'll think they have a hooked fish and will continue to play you for longer. Ignore and they go away quicker.

    To add a further point to this - the car is my wife's, but was parked by me. She however drove it out of the car park (long story).
  • The same advice applies, Ignore, Don't reply, Don't contact them.
