Private Ticket (paid)

Hi
I tried to fight a private parking ticket at a local store. I had parked in the carpark but was there less than the stipulated 2 hours. I was not very happy about this and approached teh store with steam coming out of my ears, unfortunately the first person I spoke to was not an employee - it kind of took the heat out of the situation. At the time I was given the ticket there was no mention of being seen to leave the site. However, this was added to the signeage which was easily missed a few weeks later.
I wrote telling them to take me to court within a specified period or dismiss it completely. I heard nothing until I visited teh store once more and low and behold I started getting threatening letters from a debt collector. I sometimes have trouble with my nerves and I finally paid it but I asked for a reciept - to this day I have not recived the reciept and have thought of contacting the credit card company to recover the payment but they (the private parking and debt recovery agent) hide behind the data protection act. I understand I do not live in a free country but was unaware I lived in such a policed state that my every move is monitored by people not employed by the government.

Why when you invited them to take you to court did you then decide to pay it anyway?
It should be obvious when someone harps on endlessly about doing something but doesn't actually do it, it's probably not going to happen. If they were serious they'd issue one, maybe two letters to satisfy the criteria under Civil Procedure Rules then issue proceedings. Of course they won't do that because they'd fall flat on their face since they never genuinely win.
The Data Protection Act is not relevant here since it seems you're the person responsible for paying the ticket.
You'll need to take court action against the parking company and landowner (and your credit card company as they're jointly liable) if you want your money back. You'll need more help in this regard so I've split this into a new thread for you.0 -

I agree. Plus people would be well advised to see what 'discharging a debt' really is as Hyacinth has misled .
Not that it was debt at all in this case.0
