Have a look at my PCN - can I appeal this?

(I have posted about this previously but without images)
I have attached an image of a PCN received on by my OH in his company car on 05.08.09, meaning we only have until Wednesday coming to appeal or pay the reduced fee.
He is a gas engineer and was on a job, and was unable to make the job safe in time to return to the car. He did so as fast as he could and legged it. Sods law or what?!
The ticket expired at 13.04, and my OH arrived back at 13.08, with the ticket having been issued at 13.07.
It says this on the council website:
It would seem to me that as the ticket was issued bang on the 3 mins, we don't have a leg to stand on, but I wanted to run it by you guys anyway.

is shown on the meter. Isn’t this a ‘grace’ period?The three minutes is an allowance we give as we recognise thatminutes or more.

The same principle applies to all the other parts of the protocol
where a 3 minute allowance is given.
