    I would suggest you report this to the Ombudsman at http://www.lgo.org.uk/
    They may be able to ask why nothing has happened and get a more complete answer.
  • I am currently going through the complaints procedure so I will probably have to wait for that first - it all seems so minor now and in the past - but it is frustrating and had my local TS said something along the lines of 'this ain't gonna go anywhere' that would have been that.

    Sigh....

    As discussed above, TSS do NOT deal with civil issues. They enforce criminal legislation but do not have the power to order a refund in related civil matters.

    Would you expect the Police to get your money back for you? As they have the same remit as TSS. They enforce particular criminal legislation only.

    I will agree that there appears to be a lack of clarity about what their role is, but public expectation alone cannot change that role.


    Absolutely right, but TS accepted AML were in contravention of the Sales of Goods Act, Sales Description etc which is a criminal offense and yet chose not to even threaten legal action. TS also accepted that AML contravened the Distance Selling Regulations but couldn't do anything as these regs are not enforceable in Law.
    Also I was advised by TS not to approach AML whilst they were dealing with it.
    I feel badly let down.

    Well i have just had a less than illuminating telephone call with trading standards and am waiting for a safety officer to phone me back (sometime in the next couple of days) in order to answer my query on the legalities of some jewellery that I have made (and have been selling), he tried to quote the law at me, until I quoted an exemption, which then threw him and he gave some rather strange advise and told me he was passing it up further for proper clarification, but in the meantime, I don't know if I am breaking the law or the terms of my public/product liability insurance, which means I have to pull down a load of items that I have for sale!

    To all here, would you think that an inch high bead, made to look like an ice cream or a Big Mac would actually be convincing enough to have a child try to eat it? Liquourice allsort beads I can understand, but an inch high at the most burger????
