3rd party virses hp company

hi all, i'm a newbie to this foram, please be nice to me!
i will try to keep this short and sweet.
my oh brought a car on hp, a few months later money was tight, so we deceided to sell (with hp agreement).
sold the car to a back street car dealer, he said that he will pay off the rest of the finance to the hp company. GUESS WHAT!!!! he didn't!!.
this was in feb 2007, debt still owing. oh being chased for finance as the contract is in his name.
we reported the dealer to the trading standers, he didn't even accknowadged them!. they are now taking him to the f.s.a (or something like that),to take his trading licence away.
the problem is my oh is still in debt with the hp company, they have tryed to take him to court, but didn't give the right info to their soliceters, so thats on hold.
legal advise said take the dealer to small claims court, but we have no info on him, just a mobile number. he sais he didn't work there anymore!
please any help will be great
