Thanks guys,
I looked at CAP uk and i found that they didn't have any local advisors.
I am literally working as many hours my job can give me, if there is extra shifts going, i take them, no hesitation. i don't go out, or have many hobbies.
I'm waiting for a call from B&E to finalise a cancellation. told £39 was too steep.
I rang Halifax today, the lady was lovely on the phone, we agreed to do £10 a week standing order, she said its gonna take about 6 months to bring my balance up to date, i said, that was fine. i also said if i do get extra income some weeks, i might add bits to that, to get it sorted asap. fingers crossed, no more default notices

I'm glad that you managed to get something sorted with the Halifax, how about your other creditors ?
I think you're doing the right thing to cancel your DMP with Baines & Ernst. Obviously it is your choice if you want to take on another DMC, but they have no "special powers" and can't do anything that you can't do yourself. You've obviously managed to do ok with the Halifax, so I hope you have success with your other creditors.
In my experience, having dealt with several in my capacity as someone that works in collections, DMCs are either just rip off merchants that sting people with high fees or they're just not up to the job and are just a bunch of well-intentioned old biddies that don't actually know what they're talking about.0 -
I actually spoke to B&E yesterday. he said that if i was to leave the plan, it would affect the agreement that they had in place with my creditors.
his example was Capital One. he said that if i now go ahead and cancel their plan, the agreement with capital one would be cancelled and therefore capital one can then charge interest on my account again i suppose and it would put my balance up again. i think this is roughly what he said, can they do that? could i not make an agreement with them myself? then cancel b and e. i knew what he was doing, he was sweet talking me into stay. i'm not stupid.

Have you claimed charges back and considered unenforceability? May mean you pay nothing and get lots of £££'s back in fees. Have a read here if you are interested. http://forums.moneysavingexpert.com/showthread.html?t=1868507

It's possible that it is just a scare tactic to try and stop you from cancelling the DMP. As long as Capital One receive agreed payments, I don't know why they would object to keeping your plan going. Call them and your other lenders directly and tell them you might be cancelling your DMP and want to deal with them directly and see what they say.
I would stick to your guns, but just keep your lenders informed of what you plan to do.
As for never-in-doubt's post, I think he is trying to reel you into the whole business of trying to get your debts written off as unenforceable.
Anything like that is likely to be a costly waste of time. One thing it most certainly is, is immoral.0
