Grrr! Been sold a stained, really overworn top and seller refusing refund!!!

Grrrr! Sorry before i rant but i really need an idea what to do next here:

I bought two items from a seller, a ''nwot'' girls pair of jeans and a Topshop t-shirt listed as ''lovely'' and ''white''.

What i actually received was a really badly stained t-shirt (looks like it has been washed with darks as has big grey/brown splodges all over). It also has 4 small holes and a big nasty spill mark down the back. I can post pics if you like, lol! How anyone would even wear this let alone sell it i have no idea, it really is only fit for the bin.

I contacted the seller to politely ask for a refund if i sent the item back and explained it was badly marked and had holes in. The response i got was ''sorry you feel like that but the top didn't have any holes and it is meant to be discoloured'' :eek: Funny thing is i used to have this same top and i thought i was really lucky to see it again as i accidently turned mine pink in the wash about a year ago. So i explained i had had it a yr ago and mine was white, not grey/brown tinge with tons of marks. The seller then starts being rude saying they will not refund any origional postage as the item was checked and there were no holes when it was posted, basically implying i had made them myself (oh yeah really, i buy things to ruin them the day they arrive and then have the hassle to send them back???).

fed up i opened a paypal dispute and now the seller is trying to be smart and has declined my refund request. I am 99% sure that if i send the item back the seller will refuse delivery or something and then i'd have lost out.

Does anyone know what the next step is i should take?

The worst thing is the little girls jeans i bought from them were listed as new but arrived with crumbs in the pockets, a bit bobbly and a trouser hem frayed where it had clearly been worn - i told the seller i what i found but that i was not impressed but willing to keep them as they were in a good but used condition - still not what i paid for. Grr! I feel really angry that people can't just be truthful with their listings.

    i think you need to change title as youve got buyer refusing to refund not seller

    Just esclate the dispute
  • Haha, oh no - thats my frustration showing. I don't know how to change that!!! Thank you, i wouldn't have realised for a while

    Just escalate the dispute.
  • Escalate the dispute, go through paypal to get your money back and leave Neg feedback.
  • Ok, i started a dispute, didn't realise it could be escaated further but will do. I have had a few fairly rude and abrupt messages so don't really want trouble - this person seems like a trouble maker in my opinion. Part of me is thinking just leave a neg and cut my losses, its all in all just over a fiver so not a big amount(i have blocked them incase they make a retaliation bid, as i have heard it happens).

    As i had two items sent and i have only claimed on one, would paypal still refund some of the postage or do i lose that totally, postage was a little high so thats where i would lose the money? Not phased about returning it as it'll cost just a recorded large letter to return, if it just prevents someone else landing the same fate with the seller i'll be happier.

    Click on Edit and then Go Advanced. You will be able to alter your title from there.

    Open a dispute on both items if you are not happy with them. Sounds like the seller deserves it. Paypal will tell you to return them recorded delivery, so make sure you do.

    In future, have a separate account for buying so you don't have to worry about retaliation when things like this occur.

    yes, make sure you send back by recorded so you can gt a signature.
    The seller is probably being difficult because as you mentioned you have had the top before you could be sending that one back and keeping the new clean one if you get what i mean?
    But she does sound like a dodgy seller, selling SNAD's, so escalate the claim and as long as you can get proof of delivery paypal should give you your money back.

  • You should definitely have two ebay accounts; one for buying and one for selling. If you think this person is a trouble maker then give them some trouble! Escalate both items via Paypal and then neg the hell out of them. To be honest, if you don't make a show of these dreadful sellers then they are free to do whatever they like to the next person unlucky enough to buy from them.
