Found new job cos redundancy was in pipeline - question

Hello....I have a question.


The job I left last month I left because I was told I would be being made redundant in Feb 2010 as my place of work would be closing then. As a result I felt I needed to urgently look for a job and luckily found one... I need to be grateful that I have this job and I am...but someone told me that I am entitled to compensation from old employer as due to the threat of redundancy I left..???? I kinda nver gave it a second thought but my hubby has been made redundant and so we need to explore every avenue. Any thoughts on this???? Thanks x

    It seems highly unlikely, and would certainly not be a statutory right.

    You would need to check your own employer's policies. :)

    No, the OP is entitled to nothing.

    A person is not made redundant. The position is. When the person (in this case the OP) left the role she did so of her own volition, and the role remains in place.

    You can't get redundancy payments when you resign. Your friend is totally misinformed.

    my husband will get 12 weeks in leiu and the statautory pay but someone told me he still will not be paid the full amount if you get another job straight away somewhere else! is this right? we need this redunduncy to pay off debt but a big drop in the hourly rate will cripple us otherwise.

    just to add to above, hes being made redundant tomorrow but might be able to get a job the next day.

    The person who told you that is talking nonsense.

    The only possible point to consider is if you're confusing the payments and that there is some kind of 'gardening period' clause in his contract which prohibits him from working for a competitor within a certain time frame.

    What is his job?

    I have just been through exactly the same thing. I started looking for a job as soon as I was aware that there might be a problem. I was very lucky, and was offered a new role an hour after I was put at risk and sent on gardening leave.

    I have negotiated a termination date for the end of this month, although I was on 3 months notice (it saves them my car allowance, pension contribution, bonus etc), and have signed up to start elsewhere soon.

    However, I have not told my current employer about the new job, and I have asked the new employer not to request references from the old employer until after my termination date. They have agreed to this as from their perspective it reduces my notice period. As I now have my formal, written redundancy notice and will be starting after my termination date, I'm fine, but am erring on the side of caution and not really letting people know about the new job until after my termination date (which is tough, as people are obviously concerned about me, and actually, I'm fine...!)

    From the discussions I have had with our union reps and employee reps, it seems that once you have your redundancy notice in writing, you are fine to move on (and should be able to negotiate around your termination date), but if you need to leave before you have this you will have to resign and therefore are not entitled to redundancy.

    Get the redundacy package agreed with a termination date.

    make sre any PILON is real paid PILON and not garden leave

    If you need/want to leave before this date then you can try to negotiate but risk losing any redundancy if you leave(resign) before this date or start a new job before the termination date(don't take on a new role if on garden leave).

    The other risk is that they change theire minds and withdraw the redunancy, in this case having another job offer is about the the only way to force the redundancy through.


    I think it is always best to avoid telling your current employer you have new work.
