Thank you so very much dmg24 for your help and patience, it has been a very trying time.
Can you please help me on one further thing:
If I increased my hours by no more than 5 per week taking me to 18 hours pw and increase my wages accordingly (approx £35pw) will i have to give any of it to the 'system' also i asked earlier can my hubby take part time xmas work - less than 16 hours and keep the pay ??? Would this affect any payments to SMI or indeed to anywhere????.

I am not 100% sure on your question, but have a feeling that it would not affect anything. You would definitely still have the underlying entitlement to IB JSA. The issue is whether they would still pay the full SMI amount, or whether they would deduct your earnings from this. My understanding is that SMI is worked out on an all or nothing basis, but I could be wrong on that. I'll have a read and see what I can find!
Edit: Have just spoken with a friend who suggests that this could wipe out your SMI entitlement altogether (but DH would then get his JSA payment)! Really not sure on this one - I would call the BDC and ask to speak with a Decision Maker from the SMI Team. Let us know what answer you get!Gone ... or have I?0 -
time for an update......wait for it......
today, i decided i should contact our mortgage lender to ensure that SMI payments have been made for the past 2 months (from 30/10) and to then request a drop in our part of the payment. We have been continuing to pay the full amount ourselves for the past 2 months.
I was told 'no other payments, other that the standard contractual payments have been made'
My husband then telephoned Benefits office to find out what was happening. Chap noticed immediately that no payments have been made at all - including DH 10p per week. He put a request for the mortgage payments dept to call back.
Mortgage payments called back. to say 'oh no payments have been made for some reason' a payment for 10 weeks will be made tomorrow. She then confirmed the figure to DH. It was approximately half of what we were expecting based on the letter received from the JC stating how much they would be paying and from when.
When asking for a breakdown on figures it now transpires that because we contacted the working/child tax people that DH now on IB and not CB JSA (as we were clainiming SMI we had to be on IB) on the day we received the letter from the JSA, we now qualified for WTC.
WTC has now been deducted from the SMI, is this right?
