If they breach staff rules then they will discipline, things such as unauthorised access into accounts, surfing internet during normal working time etc. It happens all the time.0

One point here you can take action as in April they lost their 'Crown Imunity' in an Act past by Gov, so it is now Law!0

I'm not sure if that is in reply to my post or not, but anyhow....I did not say he can't take action against the government. Of course he can. What I said is that if he wished to take action against an individual employee for something they had done in the course of their duties, it is the department he would need to take action against, not the individual, as the individual is acting on behalf of the department.
If the department feel that their employee committed an illegal act then they in turn can take action against the employee. If the act was immoral but not illegal then they can take disciplinary action, but can also take legal action if the employees immoral act lead to a legal battle against the employer and they suffered as a result of it, for example - NRP takes CSA to court for something which an employee of theirs has done, which has had an impact on the NRP. The act was not illegal but it was immoral, (not in keeping with standards of behaviour etc the dept expects) and resulted in a detriment to the NRP, and the judge orders the CSA to pay compensation plus costs. The CSA can then seek retribution against the employee for the financial implication.
It is the CSA the person should take legal action against, not the employee unless of course the committed act occured out with the course of the member of staff's employment.0 -
I might be able to help a little here. I am at present waiting for a Court date in the Court of Appeal. In the event the Court find in my favour, it will mean that they have found that the CSA has lied in Court. It will then mean that the people that have signed the papers and given evidence are guilty as well as the CEO, it is that simple.
Your line that they have done this as part of their job will not save them, they personally will be held accountable before a Court of Law, and the defence that were just following orders wont help them. Thus they personally are going to have action taken against them, as well as the CSA as an entity.
Had they not lost 'Crown Imunity' then they would in all probability be safe from prosicution. Does this make sence?0 -
I never a problem giving out my surname to clients as my very rare first name would be easily traced if someone felt the need to

I meticulously collect details of all my calls to CSA staff. The time, office and length of call. However, I have recently been troubled by the fact that staff are now refusing to tell me what their surname is. Dudley office for instance, had three Johns, and they always told me their surnames.
Bolton, though, refuse to tell me. My query is, what is the demands of the Citizen's Charter ... are government employees expected to tell their 'clients' their full name or not. If not, what is stopping them from making up any old first name, and fobbing you off with that.
Can I demand that they have to tell me their whole name when I am dealing with particular staff?
bolton is run by an outsource company called vertex, this may be one reason, another interesting fact is watch out for civil servants in call centres with very common surnames, they often have a 'team surname' so if you speak to someone on a particular team they would say there name is for example 'john smith' even if their surname wasnt smith, likewise someone on the next team would be 'ben jones' even though their surname wasnt jones. my ex had to be moved teams because her surname was so common it was the team surname and she would be the only one giving her real name out :rotfl:
i work in the private sector, its optional unless someone has to fax something in, people dont believe my surname is real anyway cos its a very rare irish surname

The reason they don't give full names out is security. Unfortunately there are some people who want to take physical vengeance for something someone has done in the course of their jobs. Even if an employee *has* made a mistake, I don't think it's acceptable for them to be attacked. There are enough people posting the actual address of the sites on this forum, Bolton in particular, full names of staff would mean their safety would be compromised. For every member of staff that may have made a mistake, there will be hundreds of others who have successfully ensured a non-compliant NRP pays for his kids, much to his/her disgust. Do you think they should be able to urm, "have their say"?
If you wish to report members of staff at the CSA, they all have unique extension numbers they can provide to you, along with department/team name.0 -
I work for a council. We do NOT have to give our surname, but must give the name of our manager when asked.
I disagree with this and I always give people my full name if they ask. As I work for a Council my wages are paid from out of the public purse, therefore I feel it only right they get to know my name.When dealing with the CSA its important to note that it is commonly accepted as unfit for purpose, and by default this also means the staff are unfit for purpose.0
