My gym instructor wont pay my refund

I had paid up front for gym personal trainer sessions and she just suddenly left. I have now approached her for refunds and she states that its the gyms responsibility to refund me. Ive looked at my contract with the gym and they state that all personal trainer sessions are a contract between me and them. Im just getting no where and the trainer refusing to budge. Where do I go from here cos ive not got the trainers address. I do not know either who the payment was to as I always gave her blank cheques.

Can anyone help.

  • I always gave the cheque to the trainer.As stated dont know who it was made payable to as I gave her a blank cheque

    sorry missed that bit, do you know how to locate her e.g. where she works now? can you take the contract and show her, persistance might show her you wont just give up

    Your bank should be able to tell you to whom the cheques were paid. You seem to have contact with the trainer and from what you say your contract was with the trainer so I suggest you find out where she lives and write her a letter requesting the refund. If she does not respond consider the small claims court.

    But it sounds like your business relationship with this woman was not very well defined so unless you have something which clearly states things like cost per session and number of sessions paid for in advance, I can't see you getting very far.

    NEVER give out blank cheques. :eek:

    I would gert her name from the gym then you can soon look her up I'm sure. A polite but official letter sent recorded, notifying her of the gym's policy and that if she does not refund monies you will be going to small claims court to get it back should do the trick. ;)
