Hi all,
The other day my 60 gig PS3 died
it is only 2 years old :mad:, Sony will only offer a refurb unit for £145. The fault seems to be quite common with this model which indicates it's a design issue that lead to failure. I was wondering as this has possibly not lasted a reasonable length of time considering cost and the consoles lifespan can I make a claim under Section 75 of the Consumer Credit Act for the £145?

I read an article recently concerning the fact that despite most retailers offering only a year's guarantee, actually all electrical goods could be covered for up to six years. I'm sure it was in the Mail earlier this year but the only reference I can find similar is from The Guardian in March 2006:
"Shoppers are being sold short when expensive electrical goods break down. If a TV or fridge packs up just one day after an initial one-year guarantee, customers are told they have to pay for the repair - but the truth is that retailers may be liable for up to six years.
Consumer experts say retailers are exploiting ambiguous legislation to wriggle out of their responsibilities. Ministers, however, claim the law is quite clear. The Sale of Goods Act offers protection against faulty goods even when the manufacturer's guarantee has run out. The act says goods must last a reasonable time - and that can be anything up to six years from the date of purchase."

Vikkiharris is quite correct in what she says; however, I would add that after 6 months the onus is on the consumer to prove that there is an inherent fault with the item, even during the initial 12 month warranty. This may require you to hire an independent expert to make a report on the product, and if the fault is found to be inherent, then the cost of this expert will also be refunded. after 6 months but still during the warranty period the retailer my only offer you a repair, and as you have discovered after the 12 month warranty has ended they will try not to offer anything, but a fault is a fault and if you can prove that the fault is not simply wear and tear etc then you would indeed have a claim for up to 6 years.
Beware though that you may only get a pro rata offer as it may be shown that you have had a period of use from the product.0 -
