MBNA Reclaim Help Needed Please

Hi All,

Need some advise here. I have submitted and gone through the process of trying to reclaim fees relating to my MBNA credit card. All of the charges were made up of £12.00 charges, but as I despise MBNA with such passion I still wanted to reclaim in the region of £300-400.

I received a letter stating they were investigating it, and then yesterday I received a protracted letter saying that they felt all charges were fair etc etc and that they would not pay out.

What do I next? Do I have case even though it was for £12 charges? And all charges were after July 2006 when they reduced fees to £12.
PPI Reclaimed from A&L :j
First Direct Charges Claim : Oh Hold
A&L Credit Card : £250.00 Paid :j

Write back and say the OFT didnt say £12 was fair at all, only a court could decide that, you think the £12 still far outweighs their costs and they are penaltys and should be proportionate and you;d like the whole lot back with compensatory interest of 8% per annum on top please.

I'll see if i can find a outline letter for you :)

Here something like this included in your response

    Dear Ms Powell

Thank you for your letter dated 10 July 2009, the contents of which are noted.

In regard to para 3, I can confirm that I am aware of the guidelines issued in April 2006 in relation to the level of credit card default charges across the industry and did in fact refer to these guidelines in my original letter to yourselves. As you are obviously conversant with the aforementioned guidelines you must also be aware that Para 1.11 states
“The setting of the threshold is a provisional practical measure to move the whole market towards compliance. We are not proposing that default fees should be equivalent to the threshold, and a court will certainly not consider that a default fee is fair just because it is below the threshold.”
Furthermore, following a recent Freedom of Information request to the Office of Fair Trading I was informed that
Following consultation with eight leading credit card issuers we have concluded that default charges in most credit card contracts across the sector are highly unfair in terms of the UnfairTerms in consumer Contracts Regulations (UTCCRs) and therefore unlikely to be enforceable against consumers”

Then go on to say you don't think they are fair and want the whole lot back
