Hi I am posting on my sisters account as I cant access my email to get my MSE password..


worked for compnay 3 years
been off sick 8 weeks with a pre existing condition work knew about prior to me starting
Doc states wont be fit for return for another 4 weeks minimum
I have been having regular 'home visits' etc

I have had a phone call yesteray from a co-worker who had said that we all had to re-apply for our own jobs and the deadline was last frinday..

Now work came out to see melast week and this was never mentioned.. There are only 9 of us that do the same job but it is amassive organisation, I have spoken to 3 other co-workers who have also said we need to apply for own jobs and deadline was last week.

Surely work cant do this to me? Why have I not been informed of these changes?They have a doctors report that states once i am back at work the illness should not happen again since my operation, so its not as if it will be on going?

I have a new manager that has taken over since i have been off ill and i really dont get on with her, she informed me last week that all HR issues should go through her as my new manager due to a change in how the business is run. The ppl i have spoken to seemed really reluctant to tell me the full story..so i feel left in the dark.

can they legally do this? I know i am off ill so they may not wish to discuss it atm but how will i move forward if deadline was last week? will i effectively be made redundant

    If they are proposing redundancies - and that is usually why you apply for your own job - they must consult with all staff affected. Even if they recognise a TU they must inform you and allow you the opportunity to apply.

    If you have a pre-existing condition that they have known about since you joining 3 years ago - you may also have a potential claim under the DDA.

    I would write to them advising them that you have been informed by colleagues that the Company have been asking staff to apply for their own jobs. Inform them that you were not aware of this and that you have also been informed that the deadline was last week. Finish by asking for a response within 7 working days.
