Debt of £444.69 from direct debit charge i paid back

Hi,

I set up a bank account a few years ago and they set me up 2 accounts because i got sent 2 bank cards etc... Anyway i accidently set up a direct debit with the bank account i don't use so i got charged £30 when they tried taking out the direct debit, instead of disputing it i just paid the £30 charge and a few days later they charged me a 0.09p interest charge so i paid that back aswell so the account was now back to 0.00p and i owed nothing, since i never use that account i left it and about 2 months ago i found out (from a baliff letter) that i owe them £444.69 because of the charge i paid back ages ago, i went into the bank and they can see that i paid the £30 and the 9p interest charges (i even got a print out of it) and they put a note to the manager and this will get refunded and then they will send me a letter a week later to tell me what's going on, well they didn't send me a letter back and the baliffs have been phoning me nearly everyday asking what's going on... I went into the bank yesterday and they told me that £30 got refunded from the bank so now i only owe them £414.69 - they didn't get rid of the charges (the bank i went to was only a small office so i need to go to the main one near where i live to sort this out they said) - but surely if they paid me back the £30 charge i originally paid then they should clear the other charges they put on top of it.... Am i right? The baliffs phone me yesterday aswell and told me there gonna take things further because i won't pay them anything (which i won't be) because i was waiting for a letter from the bank i never recieved... Does anyone have any advice what i should do or shall i just wait till saturday so i got time to go to the bank and kick off untill these charges get dropped....

    Write a SAR to the bank asking for the details of the charges, then write to the bank asking for it back. When the DCA next ring make them aware that you dispute the entire amount which is made up of bank charges. Remind them that to pursue a dispute debt is against OFT debt collection guidelines.

    If there is a bailiff involved has this been through court and to Judgment ?

    You need to contact your court and find out if there has been a county court claim judged against you without your knowledge and if so then apply to set it aside and put a stop to this bailiff collection. The bank/DCA and your credit file should also be abel to tell you if this is under a CCJ.

  • Well a debt collection agency keeps sending me letters and phoning me up, they rang this morning actually and i told them that they will have to wait untill saturday when i've got time to go into my bank and sort this out and they said that i'm obviously not interested in paying this back so there going to take this further?

    I've told the DCA many times before that i was waiting for a letter that the bank was suppose to send me but they didn't and i only found out yesterday that the bank only took £30 off the debt because i went to the small nationwide bank near where i work, i still haven't received no letter from them saying they refunded that - i don't see how they can refund the £30 i paid them but still keep the charges they've added on because of the £30 i originally paid them back plus the 0.09p interest charge.

    Now i want them to clear all the charges they added onto the account and refund the £30 i originally paid, that's what they should do...

    So do you advise me to ring the DCA up and explain to them that it's an disputed debt and if they try to pursue it then i will make a complaint to the office of fair trading??

    If anything the bank owe's me £30 not me owing them

    And what's an SAR?
