If you become a tenant of the new owner, there is an obligation on the part of the new landlord to arrange things like gas safety certificates etc. So you are going to have to allow some access.
Although this looks like an attempt to give you less rights and therefore "dodgy", I would reckon that the risk is the new owners. You will be occupying the property and if it turns out that you assert your full tenant (under AST) rights, he is going to have a devil of a job evicting you after 1 month and obtaining access.I'm a Forum Ambassador on the housing, mortgages & student money saving boards. You'll be a tenant with tenants rights. Quiet enjoyment, 6 months min security etc.
You could just agree in the knowledge you have far more rights than they think they are giving you. but then again do you want the hasstle? the arguements?
Personally I'd find out why they are so keen to Complete given that they will not be getting occupation any earlier., and then stick to 3 - 4 weeks between Exchange/Completion. Are they really going to pull out of the Sale if you stick to your guns?0 -
I am currently in the same position, cash buyer is buying my house for buy to let. After 4 weeks of agreeing the offer he suddenly rang up last Thursday demanding exchange and completion to be arranged by monday. The house I am moving onto will not be vacant until mid september and he is not prepared to wait that long. So despite the paperwork stating completion dates to be agreed he is now claiming he was told it would be a quick sale and is not prepared to wait so I can rent it back off him for a month if I want at £500pm (I do not pay this to live here now!).
I have now told him I can exchange this week but will not be renting it off him, we will staying with parents rent free for a month! He strangely has gone a bit quiet now!!!:rolleyes:Offer accepted - 4th July
