DiamonD Engagement Ring Fallen Apart? Help Please

Good Morning all, Hope everyone is well..
Just after advice really, need to know where i stand.
About 4 months or so ago, i bought an engagement ring for the missus-to-be, and after only a month or so, it basically snapped in half.. So i took it back, and they repaired it.. but when they gave it back is was very poor repair and looked awful, so i complained and sent if off again.

Three Weeks later we collected it and it looked like new again, but now approximately 6 weeks later again, the Diamond has completely fallen out of the ring, obviously we dont know where the diamond fell out so we dont have it, there is no obvious damage to the ring at all... so basically im wondering where do we stand with that now.
If anyone could help it would be massivly appreciated

    Can you name the shop.
    How did you pay?
    Do you have household insurance?

    It wasn't a largely known jewelers, It was just a small family run one, I paid with my Debit card and no, i dont have the insurance :(

    supply of goods and services act (as amended)

    implied terms state that services must be carried out using resonable care and skill (that of an industry professional)

    go to trading standards who shoudl be able to conciliate on your behalf and hopefully recieve a favourable response, failing that, hit small claims court and pursue like for like replacement/refund

    thanks Bbelt, i'll take it on saturday and see what they say, I have no problem shouting at them because of faulty goods or such like, but the only thing is that obviously i dont have the 'entire' item because we've lost the diamond when it fell out - nobody watches their ring all day long just incase do they...?

    :( just hope it works out well tho, missus is devastated.

    Has to be asked - was the diamond expensive? I ask as it will reflect on how hard they will argue.

    There is no services issue here in my opinion. It is a purchase of goods. Clearly it is not of satisfactory quality within the meaning of s.14(2) Sale of Goods Act. The fact that the diamond is lost kind of goes with the territory. Its not a TV that doesn't work!

    They may try and show that you have caused damage to it. May be worthwhile getting an independent report (another jewellers) to show that it was not damaged.

    They won't argue too hard as the cost to them will be substantially below this amount.

    Go for the s.14(2) argument. Let us know how you get on.
