Amazon selling 2nd hand CDs as new?

Ordered a CD recently (new), when it came the case was stamped 'return to record library'.
Tried e-mailing saying I wasn't happy but just got robotic e-mail referring me to the online return process - which specifically says you can't return CDs. Mailed again, just got more robotic e-mails.
Gave up in the end as it was only three quid.
Put feedback on the site but they deleted it.
Not too pleased, especially as I buy a lot of stuff from them.

Was it bought direct from amazon or one of their market place sellers?
One minor thing to bare in mind is that with the likes of Books/CD's etc it's not too unheard of for a retailer to return stock to a distributor as unsold (for a refund or as the deal is that they only pay for what they have sold), and the distributor will send them along to another retailer (without the retailer knowing the history of the times).
It causes some problems of the type you've encountered, but isn't the fault as such, of the retailer.0 -
Yes, it was actually from Amazon themselves.
TBH the CD is perfectly OK, but I still thought it a bit out of order, and annoying that they just wouldnt respond0 -
ring them up on their 0800 number and explain
they might refund you the money and keep the cd anyway0
