Natwest - keep charging wont accept claim - at a total loss

Right... First post here so be gentle!!
PS I have read the othere stickys and havent been able to find out what to do if they demand repayment in full.
- At christmas my wife utilized the overdraft facility on a dormant Natwest account.
- Later that month just as we were about to repay part of the overdraft natwest debited a couple of pounds interest.
- We incurred charges because THERE interest charges pushed us over our limit.
- The charges racked up, we were nieave and argued by phone and in the branch.
- The balance of -£200 jumped to -£433 when we wrote the following I am writing to request that you repay all the default charges that have been applied to my account since 31 October 2008. I do not believe these charges reflect the true cost to Natwest of going into unauthorised overdraft.
The charges total £140. I believe I have been unlawfully charged for this amount, I request that you credit the account with the charges.
If you do credit our account with these excessive charges we promise the remainder of the overdraft and interest will be repaid either by cheque, cash or payment by card immediately on receiving notice that these charges have been credited.
We would also require that you close this account as soon as the balance is £0.00 - They repsonded stating that all cases were on hold - and that we would have to wait for the results of the test case.
- The have carried on charging us at £58 per month.
- We then received a financial hardship form, which we duly filled in.
- We received a financial statements receipt, stating they were reviewing, on it we only narrowly spent more than we earned.
- We have now received demand canceling the overdraft and demanding repayment in full by the 14th August....

One thing I am intrigued by is the fact that you have a charge of £58.00 (unless that is maintenance charge and default charge).
Do you have any other accounts with NatWest?
How much is the total charges including interest add up to?

yes the fee is made up of the standard £28 charge and a default fee of £30
I have accounts with Natwest howver this account is my wifes - how would this matter?
Yes we have had other charges since 2001 but have never claimed for them, as personally we are trying tow work forward and not go bacck for various reasons, apart from this one mistake we are now reasonably astute with our money

Providing the account is not a joint account then you should be ok. Google Right of Set Off and you will see what I mean,

If you are reclaiming charges then you might as well claim EVERTHING you are owed not just since October 2008.

If you aren't in financial hardship then the bank can say no to a reclaims.
With regards to the interest, they are pre advised ie you are told in advance of when it is going out which I suspect the bank will maintain that line with you.0 -

O so they can say no to a reclaim, but are they allowed to still rack the charges up whlst Im contesting them?
Is there any point in going the court route?
Should I just give in and pay them? and hope the judgement will go our way in the house of lords?0 -

Is there any point in going the court route? All claims are being automatically stayed at county court level
Should I just give in and pay them? That is not something I can advise on because it is up to you if you want to do that
and hope the judgement will go our way in the house of lords?
If the HoL goes to the OFT then we have the second stage of the case.0
